Adidas is not allowed to register in the European Union the three banners it uses in its products as its own brand, according to a court decision on Wednesday (19).
The General Court of the European Union considered that the three bands are a common brand and that the company has not demonstrated that the stripes have acquired a "distinctive character" throughout the European bloc.
Adidas, a German multinational, had registered its three banners in 2014 at the European Union Intellectual Property Office. Two years later, the Belgian rival, Shoe Branding managed to cancel this brand.
The Luxembourg court upheld the annulment in its judgment. However, there is still recourse to the Court of Justice of the European Union.
